These critical minerals are essential for electric vehicle motors, robotics, clean energy applications and defense technologies. The White Mesa Mill, located in Utah, not only processes uranium but also extracts rare earth elements from monazite, which is known for its high rare earth content and its radioactive nature. The ability to recover rare earths while at the same time safely handling the radioactive content of monazite has allowed Energy Fuels to address supply chain issues outside China, which also processes monazite for the recovery of rare earth elements, and to set new standards for safe and sustainable rare earth processing.

Frydenlund has played a key role in the company’s efforts to develop new legal frameworks and contract strategies that address the unique challenges of the rare earth and uranium markets. “We recognized that our mill could safely and efficiently process monazite back in 2021, giving us a competitive advantage over many other rare earth producers, thereby putting us in a better position to be able to compete with China,” Frydenlund said. “That vision has driven our expansion and positioned us to become one of the world’s largest non-Chinese rare earth producers, while at the same time applying strict U.S. standards of corporate governance, health, safety and environmental sustainability.”

Legal leadership & strategic expansion

Energy Fuels has adopted a forward-thinking approach to establishing relationships with international mining companies and acquiring key assets that support its rare earth processing goals. By developing an integrated supply chain, the company has enhanced its ability to deliver critical minerals to both domestic and global markets. Frydenlund’s legal acumen has factored significantly into the company’s expansion into new markets and innovative processing methods, including the successful commercial production of a mixed rare earth carbonate from monazite and the development of a rare earth separation facility at the White Mesa Mill, enabling Energy Fuels to produce high-purity NdPr and other elements without outsourcing to foreign facilities. Completed ahead of schedule and under budget in 2024, this project solidified Energy Fuels as one of the largest non-Chinese separation facilities.

Energy Fuels’ strategy of acquiring heavy mineral sand projects in Brazil, Madagascar, and Australia, which once developed, are expected to produce monazite as a relatively low-cost byproduct of titanium and zirconium mineral production, has positioned the company to increase its planned monazite production from 10,000 to up to 60,000 tonnes annually while correspondingly increasing its light and heavy rare earth production capacity. These efforts are part of the company’s broader goal to establish an integrated supply chain independent of China’s dominance. By fostering collaborations with major stakeholders and leveraging its extensive legal experience, Energy Fuels has navigated the complexities of domestic regulations and international mineral agreements with confidence and foresight.

“We have to be creative with our legal approach, managing different jurisdictions and varying levels of risk, especially when dealing with international acquisitions and joint ventures,” Frydenlund explained. “Our legal team’s background in corporate and international mining transactions and experience dealing with the very strict regulatory regime applicable to the U.S. uranium milling industry has been invaluable in securing commercial agreements as well as ensuring compliance with complex regulations in all the jurisdictions in which we operate.”

Moreover, as the company has expanded into the rare earth industry and through its heavy mineral sands acquisitions, Energy Fuels has invested significantly in workforce expansion to ensure its team remains at the forefront of industry best practices. From 145 employees a few years ago to approximately 650 today, the company’s commitment to professional development and employee safety remains unwavering. I work closely with the President and Chief Executive Officer and other members of the management team and our advisors on a daily basis, as we deal with the issues and opportunities we face. And, with the acquisition of our heavy mineral sand projects, we have been fortunate to have added a number of very senior and experienced heavy mineral sand professionals to the team.”

A notable success story involved negotiating a historic agreement with the Navajo Nation. The company halted production at its Pinyon Plain Mine south of the Grand Canyon in mid-2024 to address community concerns about uranium transportation through Navajo land. Company representatives worked with the Navajo Nation’s senior leadership, leading to an agreement that prioritized community safety while maintaining operational integrity.

“It was a very worthwhile and productive negotiation,” Frydenlund noted. “We took the time to build trust and transparency so we understood their concerns, and they understood our concerns. Then, we worked out an agreement that was satisfactory to both parties. Under the agreement, Energy Fuels agreed to add additional protections and accommodations, over and above the existing, strict U.S. Department of transportation requirements, to address the Navajo Nation’s concerns and ensure that uranium ore transportation through the Navajo Nation will be done safely and in a manner that is respectful of the Navajo Nation’s culture and traditions. It wasn’t just about legal compliance but about doing the right thing and being a responsible corporate citizen.”

This landmark agreement facilitated renewed production and demonstrated the company’s commitment to engaging with local communities respectfully and transparently. Frydenlund emphasized that maintaining open lines of communication and understanding community perspectives is essential for long-term success.
