In industrial mechanical contracting, where multi-million-dollar projects and complex regulatory frameworks are the norm, the deputy general counsel’s role is pivotal. Meet Jason Rogers, the unsung hero behind the careful legal structuring and risk management that keep J.C. Cannistraro at the forefront of the industry.
Jason Rogers | Cannistraro | Deputy General Counsel
Most mornings, Rogers strides into the bustling Cannistraro office with a bag in hand full of contracts and legal documents, hurrying to his desk to face myriad legal questions inevitably waiting in his inbox. Others, you will probably find him stuck in Boston traffic on the Pike heading to a meeting, negotiation, or arbitration downtown. But occasionally, you will catch him on one of his many “field trips,” donning his hard hat, beat-up Redwings, and PPE.
“The work is always interesting, and the view is always changing. In fact, some of the most fun comes when I am deep into a project with our operations team and have hard conversations with project leaders to navigate on-the-job disputes far from the confines of any office or courtroom,” Rogers explains.
Cannistraro, one of Boston’s premier industrial mechanical contractors, specializes in HVAC, plumbing and fire protection systems. With a reputation for excellence and innovation, the company has grown from a small family-owned plumbing shop to the largest mechanical contractor in the city. Known for taking on high-stakes, large-scale projects, Cannistraro has expanded its operations while staying true to its mission of putting people first.
By balancing legal acumen with a deep, hard-earned understanding of construction, Rogers ensures that the organization survives and thrives in a risky environment.
“My approach to work is proactive and analytical, ensuring that risks are mitigated before they become disputes,” he explains. “By enhancing insurance programs, incident reporting, and risk management measures, we’ve helped streamline many internal processes at Cannistraro.”
Ensuring safety and compliance
While his title may not reflect all his contributions to the company, Rogers’s knack for strategic thinking is no secret to those who work with him in the office and the field. His background in construction law, which has seen him represent the full spectrum of entities in the industry for over 11 years, makes him an invaluable asset. He negotiates all types and levels of contracts—from NDAs to design-build agreements—while working closely with Cannistraro’s operations teams to ensure contract compliance and answer project-related questions.
Despite the challenges and risks of taking on high-stakes, large-scale projects, Cannistraro has thrived under his legal guidance. From overseeing contract negotiations to navigating complex construction-related issues, he remains vital to the company’s growth and success. Despite his behind-the-scenes role, Rogers’ impact on keeping Cannistraro at the cutting edge of the industry is undeniable.
He takes pride in finding solutions that balance risk management with the company’s growth goals. His approach prioritizes collaboration over conflict and aims to distribute risks to those best equipped to handle them. Through his work at Cannistraro, Rogers continues to drive innovation and ensure the company remains a leader in Boston’s construction industry. His focus on people, process, and project management solidifies his role as a key figure in the company’s future success.
Rogers discovered his strong affinity for construction law shortly after graduating from law school. Enthralled by its complexities and challenges, he excelled in an associate position at a boutique construction firm, thus marking the beginning of his journey as a construction lawyer. After cutting his teeth in New York City, Rogers moved to Boston, where his career path shifted about three years after meeting Regina McGregor, Cannistraro’s general counsel. She offered him the opportunity to work in-house, which he eagerly seized, transitioning from reactive problem-solving to proactive risk management. Now, Rogers develops comprehensive strategies to mitigate risks and trains project teams to anticipate and avoid potential legal issues, ultimately enhancing project efficiency and success.
Rogers assisted in negotiating Cannistraro’s work on the Leiden Center for Cell and Genetic Therapies Expansion, a 344,000-square-foot research and manufacturing facility in Boston’s Seaport district. In partnership with Related Beal and Consigli Construction, Cannistraro provides the cutting-edge facility’s plumbing, HVAC, and fire protection work, which will be a hub for genetic therapy research and clinical manufacturing. Rogers’ legal expertise was instrumental in navigating the complexities of this high-profile project, including managing risk and ensuring contract clarity.
Managing risk and more
Rogers also leads efforts to address ongoing legal challenges facing Cannistraro, particularly in safety, risk mitigation and supply chain management. For example, Rogers is working with the safety team to implement a “near-miss, good-catch” program, encouraging field leaders to report unsafe conditions before they escalate into serious issues. He’s also spearheading routine safety walks and internal audits to ensure compliance with industry standards and further reduce potential liabilities.
“In high-stakes projects, success hinges on proactive risk management and strong collaboration. We anticipate challenges, clarify contracts, and align teams to ensure smooth and timely delivery,” Rogers says.
While the legal challenges in construction can be daunting, Rogers takes pride in finding solutions that balance the need for risk mitigation with Cannistraro’s goals. He is acutely aware of the dual responsibility to protect Cannistraro while maintaining solid relationships with partners and clients. His approach is one of collaboration rather than conflict, aiming to distribute risks to the parties best equipped to manage them.
Through his work at Cannistraro, Rogers continues to shape the company’s legal strategies and play a crucial role in its growth and success. His focus on people, processes, and project management positions him as a key figure in the company’s future, driving innovation and ensuring that Cannistraro remains at the forefront of Boston’s construction industry.
“Construction, no matter how well designed or engineered, is imperfect. It is my job to react to the issues created by those imperfections. Our work always presents me with new problems and challenges me to develop new and creative ways to mitigate them,“ he says.
