Shaping the future of public data regulations

Frank’s leadership was pivotal during a lengthy FTC investigation into PeopleConnect’s compliance with the Fair Credit Reporting Act. The scrutiny focused on whether the company’s data was being used inappropriately for employment or tenant screening. Under Frank’s guidance, PeopleConnect successfully negotiated a consent order with the FTC, establishing new operational guidelines for the people search industry. This outcome validated the company’s business model and set a new regulatory standard, shaping the industry’s future.

Another major challenge Frank and his legal team tackled involved defending PeopleConnect against multiple rights of publicity class actions related to its people search and Classmates.com brands. These lawsuits addressed using peoples’  images and identifying information in search results, requiring a careful balance between First Amendment rights and privacy concerns. The company’s strategic defense is mitigating the impact of these actions, ensuring the company continues its normal operations without compromising legal standards.

Frank has been actively involved in addressing evolving privacy and data regulations. With PeopleConnect managing billions of data inputs and serving over two million active subscribers, staying compliant with state and federal privacy laws is crucial. Frank’s role includes advocating for carve-outs that recognize the use of public data under the First Amendment, ensuring that the company’s services remain lawful and effective.

From politics to law

Frank’s path began with a strong foundation in national politics. While still in Kalamazoo College, he worked for George H.W. Bush’s PAC in D.C. under Lee Atwater. This early political involvement included work on the primary and general election campaigns, the inaugural committee and then the Pentagon after graduation. A pivotal moment came when Atwater, facing a terminal illness, advised his former young staff to gain experience outside of D.C. Inspired, Frank chose to pursue a law degree.

Law school was challenging, but Frank’s perseverance led him to graduate in the top 10 percent of his class. Despite initial setbacks, including a disrupted job search, he found work at a mid-size law firm in San Diego and later transitioned to in-house roles. Over time, he built a successful career with stints at Hill’s Pet Nutrition, Johnson Controls, and Las Vegas Sands Corp., where he managed a large international team and learned the value of delegation.

Frank joined PeopleConnect in July 2020, bringing a wealth of experience from private practice and in-house roles. His passion for the First Amendment and facilitating access to public records has driven his success in his current role. His diverse background, from political beginnings to significant legal roles, has equipped him well for the challenges and responsibilities he faces at PeopleConnect.

“My advice to any in-house lawyer is to find work that engages your passions and pursue opportunities that allow you to make significant impacts, both for your company and the profession,” Frank says.
